Access Adventures Terms & Conditions of Business – Wakeboard sessions

1. General Issues

These Booking Terms and Conditions apply to the booking of any of the Access Adventures wakeboard sessions and the activities on this session (the Activities), at the location set out in Access Adventures' booking confirmation.
No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Access Adventures
Any typographical, clerical or other error or omission in any booking confirmation or other documentation issued by Access Adventures (including any electronic documentation) shall be subject to correction without any liability on the part of Access Adventures
Access Adventures reserves the right to make changes to the Activities whether to conform with any applicable safety or other statutory requirements or otherwise

2. Booking Confirmation

No booking shall be deemed to have been accepted until the booking confirmation form has been completed and an automatic message received.
These Booking Terms and Conditions incorporate Access Adventures' Privacy Policy, and Risk Acknowledgement and Disclaimer. You must advise Access Adventures as soon as possible of any mistake in the booking confirmation. Access Adventures shall use its reasonable endeavours to ensure that your participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances

3. Safety

Participation in the Activities of Access Adventures are not without risk. All participants will receive necessary safety training
Access Adventures reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should deem it necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.
Participants must sign a Risk Acknowledgement and Disclaimer stating that he or she will accept responsibility for the safety of him or herself
All participants for the activities must be reasonably fit and healthy.
All participants are required to wear any safety equipment provided by Access Adventures
The Activities are physically demanding and require a degree of agility, strength and stamina. If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the Activities, Access Adventures recommends that pregnant women should not take part.
All participants are required to act responsibly and courteously at all times and to respect other participants. Access Adventures shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.
Participants must be dressed appropriately and Access Adventures reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.
No refunds or compensation will be payable by Access Adventures in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for the reasons set out in this clause.

4. Clothing

It shall be the responsibility of all participants to ensure that they are dressed appropriately and Access Adventures advises participants to wear clothing appropriate for the weather conditions and which they do not mind getting damaged.

5. Fees & Cancellations

Places can only be reserved by Access Adventures receiving a completed booking form and the full payment
50% of the payment is a non-refundable deposit
Cancellations up to 1 week before the camp – clients are entitled to a refund, minus the 50% deposit
Cancellations after 1 week before the camp - clients lose the full payment
Access Adventures shall be entitled to cancel your booking at any time. In the event that Access Adventures decides to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause but no other compensation shall be payable.
In the event that it proves necessary to close the Activities for reasons beyond the control of Access Adventures and in circumstances where your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole). In such circumstances Access Adventures may, but shall not be obliged to, offer alternative camps at reduced rates.

6. Liabilities

Except as otherwise provided in these Booking Terms and Conditions Access Adventures shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.
Participants are responsible for arranging their own transport to the accommodation / activity location
Parking facilities are available at most sites, and any vehicles are left at the owners’ risk and subject to any conditions.
Except as otherwise provided in these Booking Terms and Conditions any liability of Access Adventures shall be limited to the refund of any charges paid to Access Adventures.

7. Insurance

Access Adventures recommends that all customers take out personal insurance for the Activities.

8. Photographs

Access Adventures may take photographs or video during your activity. These images remain the property of Access Adventures and may be used as a marketing resource by Access Adventures . This may include the use of images on Access Adventures website, our Facebook page and other social media sites.
If you do not wish Access Adventures to use or publish these images then please notify us of this in writing.

9. Data Protection

All information passed to Access Adventures will be treated as confidential and will only be passed to third parties with the prior consent of the customer.
Participants should know that information may be passed to affiliates or the national awarding bodies as is appropriate for the running of courses.
Email address will not be passed to any other persons or companies apart from the situation described above.

10. Weather

Some activities require particular weather conditions. We endeavour to plan activities for the time of year that we would expect to get the appropriate weather.
Blue/ green algae can be a problem in the lake – if we are advised that the level is such that it presents a health risk, the camp will be cancelled
If a camp is cancelled at this point then customers will be offered an alternative date if this is feasible or a full refund.

11. Miscellaneous

If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.
These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and Access Adventures and you submit to the exclusive jurisdiction of the courts of England and Wales
